Terms & Conditions

1. Refer to our website or Mindbody online for the current live schedule. Bikram Hot Yoga Ascot Vale (BYAV) prides themselves on running to the schedule, but reserves the right to cancel classes if necessary. Class schedule is modified &/or restricted over the warmer summer months (December / January / February) and around public holidays.
2. Doors close strictly on time for safety and security. Please aim to arrive 15 mins prior to class. Late entry is not permitted.
3. Bikram Yoga Ascot Vale reserves the right to refuse entry at anytime.
4. BYAV does not take any responsibility for any personal belongings brought into or left at the studio.  Lockers are provided for personal belongings.
5. You consent to BYAV’s use of your image in any promotional materials, including on social media accounts.
6. BYAV will use its reasonable endeavours to provide the services at the times specified but will not be liable for any loss or damage suffered by you or any third party for any late or cancelled classes or sessions, including classes and sessions cancelled due to public holidays or otherwise.
7. Cancellation Policy – Refer to FAQs page for “Cancellation Policy”& “6am Booking Policy”.  Strict “6am Booking Policy” applies to 6-7.30am classes.
8. Direct Debit Monthly Membership.  Ongoing membership, min 3 full monthly payments. After 3 months, membership will continue, without notice even after min 3 mths, until terminated in writing per terms by either party.  If cancelled prior to min 3 payments, a cancellation fee of $250 will be charged.
9. • Standard Rate $124 p/m or $114: Minimum 3 mths due ($372 or $342), or a cancellation fee of $250 will be charged.
   • First Time Member Special: Available to students who join prior to first time studio “Intro Offer” expiring (no exceptions).  Offer subject to change.
   • Other information – Default payments: $10 decline fee may be deducted without notice for each/any unsuccessful transactions.  Suspensions (Holds): Maximum 1 hold per 3 months. Not to exceed 28 days in 12 months (accrued each 3 months on a pro-rata basis). No holds in first 3 months.  A form must be completed at the studio to activate a suspension. A $10 admin fee will be charged for any account adjustments/suspensions etc.  Termination: To discontinue, a cancellation form must be completed at the studio. Direct Debit must be active for one full payment cycle (minimum^) prior to cancellation. All contracts are ongoing until such time that cancellation form completed at the studio, and an email to admin@bikramyogaav.com.au received, followed by final email from BYAV confirming termination.
   • Account changes:  All requests must be received min 7 days prior to the requested start date.   All request must be in writing, initiated by the client & reply confirmed by BYAV.  An admin fee will be charged for each/any account change.
   • Special Offer or Rates: Management reserves the right to decide if a student is or not eligible for any Special Offers or Discounts.  Students accept the agreed pricing on purchase or contract signing.  If pricing is unclear on joining/signing, please email info@bikramyogaav.com.au for clarification prior to completing contract.   Retrospective adjustments (including credits) can not be made once contract signed.
   • Cancellation fee: Full terms must be met, including min 3 payments, or cancellation fee applies ($250).
   • When joining Direct Debit you are also accepting the T&Cs of Ezidebit.  “Ezidebit” will appear on your bank statement.  See DDR Service Agreement and Ezidebit website for details.
10. All Passes (purchases) have strict expiration &/or “activate by” dates. These are published at the studio &/or on the pass, please take note of these dates. No extensions permitted.  “Activate within 12 months” only applies to full price unlimited items.  From 1.7.17 all full price items must be activated no later than 6 mths from purchase date;  Intro/Re-Intro/Welcome Back Offers must be activated within 30 days of purchase.
11. Pass changes:  All request must be via email, initiated by the client & reply confirmed by BYAV.  Changes permitted only on full price, Direct Debit passes.  No verbal or phone requests will be accepted.
12. Sale / Discounted Passes:  Strictly no extensions, suspensions / holds, refunds or transfers on any pass sold at a discounted or sale price, unless stated as part of sale terms.  All sale passes must be ‘activated’ (i.e. first use) &/or used per terms of the sale.  Pass ‘activation date’ may vary for an individual sale item, but will be up to a maximum of 6 months from date of purchase. Any sale pass not activated per conditions will be considered expired.
13. Suspensions / Holds: Permitted on standard price 12 month and Direct Debit only. 12 Month Unlimited Pass – 3 holds allowed, up to a maximum of 28 days in total (accrued prorata at 7 days every 3 mths). Direct Debit – see above. No holds on Passes purchased as part of any special sale (ie discounted rate).  An administration fee will be charged for each change.
14. Double classes: Membership clients (i.e. Direct Debit & 12 month pass) are entitled to attend an unlimited number of classes, including more than one class on a single day (i.e. double class / back-to-back). Clients on Class Passes will be charged for each class if participating in more than one class on the same day.
15. Membership/Members: Membership clients include 12 month unlimited passes and Direct Debit.  Members are entitled to unlimited access to all classes.
16. Gift Vouchers: Expire 6 months from date of purchase.  Please treat these like cash as we take no responsibility for lost gift cards.
17. Special Events: Members will receive priority entry, special discounts, or free (as applicable) access to all special events & workshops.  Non-members may pay a nominated fee.  Events may, but not limited to, guest teachers classes, workshops, teacher training or other special events.
18. Offers (e.g. Intro, Re-Intro and ‘Welcome Back’ or similar):
    1. All ‘Offers’ must be activated (i.e. ‘Day 1’) within 30 days of purchase, or pass expires.  No holds, extensions, transfers, refunds.   Online vs In-Store pricing may vary.  Valid for residents only, proof of address may be required.  Offer/s subject to change without notice.  Management/ staff reserve the right to determine student eligibility for all / any Offers.
    2. Introductory Offer: Pass is valid for 30 consecutive days from activation and includes unlimited access to regularly scheduled classes (during the pass activation period).  Valid once only to new students.
    3. Re-Intro Offer may be available to students who have not visited BYAV in the last 12+ months and available once only per student.
19. No refunds will be given except where required by Australian Law.
20. BYAV reserves the right to review and increase prices from time to time without notice.  BYAV reserves the right to update or amend these terms and conditions at any time without notice.  You will be deemed to have read and accepted these Terms and Conditions, including any changes, each time you use the Site &/or participate in a class at BYAV.

Concessions

* Concession pricing is available to full time students and concession card holders with valid photo identification.
